Statute of Limitations: 3 years from the date of injury for most personal injury claims (N.C. Gen. Stat. § 1-52(5)). Wrongful death: 2 years from the date of death (§ 1-53(4)).

At-Fault State: North Carolina is an at-fault state. The party responsible for the accident is liable for your damages. You pursue the at-fault party's insurance.

Pure Contributory Negligence (Critical — NC-Specific): North Carolina is one of only four states in the country that follows pure contributory negligence. If you are found even 1% at fault for an accident, you may be completely barred from recovering any compensation — regardless of how severely you were injured or how much the other party was at fault. Exceptions exist for the Last Clear Chance doctrine (defendant had the final opportunity to avoid the accident but failed to do so) and gross negligence or willful and wanton misconduct. Insurance companies use this rule aggressively to deny claims.

Insurance Minimums (Updated July 1, 2025): North Carolina enacted Senate Bill 452 (S.L. 2024-29), raising minimum liability limits to $50,000 per person / $100,000 per accident bodily injury / $50,000 property damage. UM/UIM coverage is now mandatory in all new and renewed policies. Inter-policy stacking of UM/UIM is now permitted.

Minor Tolling: Minors have 3 years after their 18th birthday to bring most personal injury claims (§ 1-17(a)).
