IMPORTANT NORTH CAROLINA LEGAL INFORMATION — WORKERS COMPENSATION

Coverage Requirement: North Carolina law requires most employers with 3 or more employees to provide workers' compensation coverage (N.C. Gen. Stat. § 97-13).

Notice Requirement: Report your injury to your employer as soon as possible and within 30 days of the accident (N.C. Gen. Stat. § 97-22). Failure to give timely notice can jeopardize your claim unless the employer had actual knowledge or can show no prejudice.

Filing Deadline: 2 years from the date of the accident to file a claim with the North Carolina Industrial Commission (N.C. Gen. Stat. § 97-24). If the employer has paid compensation, the 2-year period does not apply during payments.

Exclusive Remedy Against Employer: Workers compensation is generally the exclusive remedy against your employer. You cannot separately sue a covered employer for negligence in civil court.

Third-Party Claims: If a third party — contractor, equipment manufacturer, property owner — caused or contributed to your injury, a separate personal injury lawsuit is available. North Carolina's 3-year personal injury SOL (§ 1-52) applies, but North Carolina's contributory negligence rule also applies.

Retaliation Prohibited: North Carolina's Retaliatory Employment Discrimination Act (REDA, N.C. Gen. Stat. § 95-241) prohibits retaliation for filing a workers comp claim. Claims must be filed within 180 days of the retaliatory action.
