Wrongful death is the most devastating outcome of someone else's negligence. Car accidents on Charlotte's most dangerous corridors, construction accidents across Mecklenburg County, medical malpractice at area hospitals, and workplace incidents claim lives every year. Charlotte recorded 85 traffic fatalities in 2024 — the highest since tracking began — with pedestrian deaths rising sharply. Families are left without a spouse, a parent, a child — often without the financial support that person provided. Insurance companies and defense attorneys may minimize the loss of life and use delay tactics to pay grieving families as little as possible. TopDog fights to get you every dollar your family deserves.

Wrongful deaths in Charlotte happen on I-77 and I-85, in construction zones across Mecklenburg County, in hospital rooms at Carolinas Medical Center and Novant Health Presbyterian, and in workplaces throughout the metro. We know how these cases are built in North Carolina and how to hold defendants accountable. Those losses cause real damage to families and we fight to get them the justice and financial security they deserve.
Insurance companies and defense attorneys across Mecklenburg County often use delay, denial, and lowball tactics and pay grieving families as little as possible. North Carolina's contributory negligence rule is used even in wrongful death cases — defense attorneys will try to assign any share of fault to the deceased to bar the entire recovery. We know how to leverage the justice system in North Carolina courts to protect your family's right to full recovery.
IMPORTANT NORTH CAROLINA LEGAL INFORMATION — WRONGFUL DEATH
Statute of Limitations: 2 years from the date of death (N.C. Gen. Stat. § 1-53(4)). The clock starts on the date of death — not the date of the original injury. Note: 2 years for wrongful death versus 3 years for personal injury — wrongful death has a SHORTER deadline.
Who Can File (N.C. Gen. Stat. § 28A-18-2): The personal representative of the deceased's estate must file the wrongful death action. If no personal representative has been appointed, one must be appointed through the probate court before filing.
Medical Malpractice Wrongful Death: Subject to the same procedural requirements as other med mal claims — Rule 9(j) expert affidavit required with complaint. Also subject to the 4-year statute of repose: if the negligent act occurred more than 4 years before the death, the wrongful death claim based on that malpractice may be barred (§ 1-53(4) proviso).
Contributory Negligence: North Carolina's pure contributory negligence rule applies to wrongful death cases. If the deceased was found to have contributed in any way to the cause of their death, the family's recovery may be completely barred. Limited exceptions: Last Clear Chance doctrine and gross negligence.
Recoverable Damages (§ 28A-18-2): Medical and funeral expenses, pain and suffering of the deceased before death, loss of income the deceased would have earned, loss of companionship for surviving family members, and punitive damages where appropriate.
This is a brief summary of commonly applied laws in the jurisdiction. There are often different laws that apply to different circumstances. Once you hire TopDog, your attorney will advise you on the applicable laws.
Insurance companies and defense attorneys may make early low offers and use delay tactics to minimize the loss of life. North Carolina has no cap on wrongful death damages — but the contributory negligence rule means defense attorneys will try to assign fault to the deceased to bar the entire recovery. TopDog Law fights to establish full fault on the defendant and secure your family's full recovery.
