IMPORTANT NORTH CAROLINA LEGAL INFORMATION — MEDICAL MALPRACTICE

Statute of Limitations: 3 years from the date of the last negligent act or omission (N.C. Gen. Stat. § 1-15(c)). When the injury is discovered later (discovery rule): 1 year from the date the injury was discovered or reasonably should have been discovered — but this cannot extend past the 4-year repose.

4-Year Statute of Repose: No medical malpractice claim may be filed more than 4 years after the date of the last negligent act, regardless of when the injury was discovered (§ 1-15(c)). Exception: foreign objects left in a patient — 1 year from discovery, up to 10 years from the act.

Minor Exception: A claim on behalf of a minor must be filed within the statute of limitations or before the minor reaches 10 years of age (whichever is longer). Families should not assume the child has open-ended time to file.

Rule 9(j) Expert Affidavit Required: Under N.C. R. Civ. P. 9(j), a medical malpractice complaint must be accompanied by certification that a qualified expert has reviewed the medical records and believes the defendant's care fell below the standard of care. Failure to comply results in dismissal of the complaint.

No Pre-Suit Notice Required (Private Providers): North Carolina does not require pre-suit notice before filing against private healthcare providers.

Noneconomic Damages Cap: $712,847 as of January 1, 2026 (N.C. Gen. Stat. § 90-21.19, adjusted by OSBM for inflation every 3 years). Cap is waived if the plaintiff suffered disfigurement, loss of use, permanent injury, or death AND the defendant's conduct was reckless, grossly negligent, fraudulent, intentional, or malicious. Economic damages — medical bills, lost wages, future care — are NOT capped.
