Statute of Limitations: 1 year from the date of injury for most personal injury claims (Tenn. Code Ann. § 28-3-104). This is one of the shortest personal injury deadlines in the country. Missing it means losing your right to sue permanently.

At-Fault State: Tennessee is an at-fault state. The party responsible for the accident is liable for your damages. You pursue the at-fault party's insurance.

Comparative Fault — 50% Bar: Tennessee follows modified comparative fault (McIntyre v. Balentine; Tenn. Code Ann. § 29-39-102(b)). You can recover if your fault is less than 50%. Your award is reduced by your percentage of fault. If you are found 50% or more at fault, you cannot recover.

Noneconomic Damages Cap: Tennessee caps noneconomic damages (pain and suffering, emotional distress, loss of enjoyment of life) at $750,000 per injured plaintiff (Tenn. Code Ann. § 29-39-102). The cap increases to $1,000,000 for catastrophic injuries including spinal cord injury resulting in paraplegia or quadriplegia, amputation of two limbs, third-degree burns over 40% or more of the body, or wrongful death of a parent with minor children. Economic damages (medical bills, lost wages, future care) are NOT capped.

Government Entity Claims: Claims against Memphis city government, Shelby County government, or other governmental entities are governed by the Tennessee Governmental Tort Liability Act (Tenn. Code Ann. Title 29, Chapter 20). Notice requirements and immunity provisions apply.
