Recoverable Damages (Tenn. Code Ann. § 20-5-113): Both (1) damages for the deceased's pain and suffering, lost earnings, and medical expenses from injury to death, AND (2) damages to the surviving family members — loss of support, loss of companionship, and mental anguish.
Comparative Fault — 50% Bar: If the deceased was 50% or more at fault, the family cannot recover (Tenn. Code Ann. § 29-39-102(b)).
Noneconomic Damages Cap: Tennessee's $750,000 cap applies to noneconomic damages in wrongful death cases. The cap increases to $1,000,000 if the wrongful death involved a parent of minor children (Tenn. Code Ann. § 29-39-102(d)(4)). Economic damages — lost future income, medical bills — are NOT capped.
