IMPORTANT TENNESSEE LEGAL INFORMATION — SEXUAL ABUSE
Adult Survivors — Danielle's Law (Effective April 4, 2024): Tenn. Code Ann. § 28-3-118 extends the civil statute of limitations for adult survivors. If law enforcement was NOT notified: 3 years from the sexual assault. If law enforcement WAS notified: 5 years from the sexual assault. This is a significant expansion from the prior 1-year general deadline.
Child Survivors — New Law (Effective July 1, 2025): For child sexual abuse occurring on or after July 1, 2019: survivors have until the later of 30 years after their 18th birthday (until age 48) OR 3 years from discovery (Tenn. Code Ann. § 28-3-116(b)(2), as amended eff. July 1, 2025). This is an expansion from the prior 15-year deadline.
Child Survivors — Older Abuse (Before July 1, 2019): For abuse occurring before July 1, 2019 that was not discovered at the time, survivors have 3 years from the date of discovery (§ 28-3-116(b)(1)).
No Retroactive Lookback Window: Unlike some states, Tennessee has not enacted a retroactive lookback window. Previously time-barred claims remain barred.
Institutional Claims: Institutions can be held liable if they knew or should have known about abuse. Actions against institutions filed more than 1 year after age 18 require corroborating evidence (§ 28-3-116(f)).
No Criminal Conviction Required: A civil lawsuit can proceed regardless of whether criminal charges were filed.
