Statute of Limitations: 5 years from date of injury for most personal injury cases — RSMo § 516.120(4). This is one of the longest deadlines in the country. Wrongful death: 3 years from date of death — § 537.100. Medical malpractice: 2 years — § 516.105. Each case type carries its own deadline.
Government Entity Deadline (Critical): Claims against the City of St. Louis, St. Louis County, or Metro Transit (MetroBus/MetroLink), require written notice within 90 days under the Missouri Tort Claims Act for municipal claims, and state-level government entities require written notice within 180 days. — RSMo §§ 537.600 et seq. Sovereign immunity is waived only for (1) negligent operation of a government vehicle and (2) dangerous conditions on public property.
St. Louis Split Jurisdiction (Critical): The City of St. Louis is an independent city, entirely separate from St. Louis County. Cases involving City entities go to the 22nd Judicial Circuit Court. Cases involving County entities go to the 21st Judicial Circuit Court. This affects venue and which government entities are involved.
Comparative Fault: Pure comparative fault — RSMo § 537.765. You can recover even if you are 99% at fault. Your award is reduced in proportion to your fault but never eliminated. No fault bar. This is more favorable to injured people than neighboring Illinois (51% bar) or Kansas (50% bar).
At-Fault State: Missouri is an at-fault state. The driver who caused the accident is responsible for your damages.
Insurance Minimums: $25,000 per person / $50,000 per accident bodily injury / $25,000 property damage — RSMo § 303.190. Uninsured motorist coverage required.
