IMPORTANT MISSOURI LEGAL INFORMATION — MEDICAL MALPRACTICE
Statute of Limitations: 2 years from the date of the negligent act — RSMo § 516.105. Missouri follows the OCCURRENCE rule, not the general discovery rule. The clock starts when the malpractice happened, not necessarily when you discovered it.
Limited Discovery Exceptions (Narrow): Two situations extend the 2-year clock:
(1) Foreign object left in body: 2 years from the date of discovery — § 516.105(1).
(2) Failure to inform patient of test results: 2 years from date the patient discovered or should have discovered the failure — § 516.105(2).
10-Year Statute of Repose: For adults, Missouri enforces a strict 10-year absolute cutoff from the date of the neglect. However, for minors, the law explicitly applies whichever date is later between 10 years or the child's 20th birthday. A child has until their 20th birthday to file.
Minor Exception: If the injured patient was under 18 at the time of malpractice, the deadline extends until their 20th birthday — § 516.105(3). However, Missouri's general minor tolling statute (§ 516.170) does NOT apply to medical malpractice — Batek v. Curators of Univ. of Mo., 920 S.W.2d 895 (Mo. banc 1996).
