IMPORTANT LOUISIANA LEGAL INFORMATION

Statute of Limitations (Prescriptive Period): For incidents occurring on or after July 1, 2024, the prescriptive period is 2 years under La. Civ. Code art. 3493.1. For incidents occurring before July 1, 2024, the prior 1-year prescriptive period applied. Wrongful death: 2 years from the date of death. Medical malpractice: 1 year from discovery, 3-year absolute maximum.

Comparative Fault (Critical 2026 Change): Louisiana recently changed its fault system. For incidents occurring on or after January 1, 2026, Louisiana now follows modified comparative fault with a 51% bar under La. Civ. Code art. 2323 (Act 15, 2025). If you are found 51% or more at fault, you cannot recover any damages. For incidents before January 1, 2026, Louisiana's prior pure comparative fault system applied — meaning you could recover even if 99% at fault (with recovery reduced proportionally).

At-Fault State: Louisiana is an at-fault state. Direct Action Statute: Louisiana's unique direct action statute means you generally cannot sue the insurer directly anymore. You must sue the at-fault driver.

Insurance Minimums: $15,000 per person / $30,000 per accident bodily injury liability; $25,000 property damage liability (15/30/25) under La. R.S. § 32:900(B).

No Pay, No Play (Updated August 1, 2025): Louisiana's No Pay, No Play law was strengthened effective August 1, 2025. Uninsured drivers cannot recover the first $100,000 for bodily injury and the first $100,000 for property damage, even if the other driver was 100% at fault.
