IMPORTANT LOUISIANA LEGAL INFORMATION
Prescriptive Period (Louisiana's term for statute of limitations): 2 years from date of injury for most personal injury cases — La. Civ. Code Art. 3493.11 (effective July 1, 2024, for injuries on or after that date). Injuries before July 1, 2024 are subject to the prior 1-year period.
Wrongful Death: The longer of 1 year from date of death or 2 years from date of injury — La. Civ. Code Art. 2315.2(B) (effective August 1, 2025). Exception: Medical malpractice wrongful death remains 1 year from date of death.
Government Entity Claims (Critical): Claims against the City of Baton Rouge, East Baton Rouge Parish, CATS buses, LSU and other state entities are governed by Louisiana's governmental immunity framework. State entity damages are capped at $500,000 under La. R.S. § 13:5106. Written notice requirements vary by entity — consult an attorney immediately after any incident involving a government vehicle or property.
Comparative Fault (Changed January 1, 2026): Louisiana adopted a modified comparative fault system — La. Civ. Code Art. 2323 as amended by Acts 2025, No. 15, effective January 1, 2026. If you are found 51% or more at fault, you cannot recover. If less than 51% at fault, your recovery is reduced proportionally. This replaced the previous pure comparative fault system.
At-Fault State: Louisiana is an at-fault state. The driver responsible for an accident is liable for your damages.
Insurance Minimums: $15,000 per person / $30,000 per accident bodily injury / $25,000 property damage — La. R.S. § 32:900(B). No-Pay, No-Play Law: Uninsured drivers cannot recover the first $100,000 in bodily injury or $100,000 in property damage even when the other driver is at fault (La. R.S. § 32:866).
