IMPORTANT LOUISIANA LEGAL INFORMATION — MEDICAL MALPRACTICE
Prescriptive Period: 1 year from the date of the alleged act or discovery of the act — La. R.S. § 9:5628. This is DIFFERENT from Louisiana's general 2-year prescriptive period for personal injury. The 2024 general 2-year extension DID NOT apply to medical malpractice. Medical malpractice still runs on a 1-year clock.
Hard 3-Year Repose: No medical malpractice claim can be filed more than 3 years from the date of the negligent act — regardless of when you discovered it — La. R.S. § 9:5628.
Mandatory Medical Review Panel (Critical): Before filing a malpractice lawsuit in court against a qualified healthcare provider, you must first file a complaint with the Patient's Compensation Fund, which convenes a medical review panel. Filing the complaint suspends (pauses) the 1-year prescriptive period while the panel deliberates. After the panel issues its opinion, you have 90 days to file in court.
Damages Cap: Louisiana caps total medical malpractice damages at $500,000 (excluding future medical costs) under La. R.S. § 40:1231.2. Future medical costs above $500,000 are paid by the Patient's Compensation Fund.
Government Hospital: LSU Health, Our Lady of the Lake (not a government entity), and Baton Rouge General (private). LSU Health hospitals are state entities — government immunity rules apply and may require additional procedural steps.
Comparative Fault: Modified comparative fault — 51% bar — La. Civ. Code Art. 2323 (effective January 1, 2026).
