Benefits of Hiring Our Philadelphia Workers’ Compensation Lawyer to Handle Your Case

Philadelphia personal injury Lawyer

In a workers’ compensation case, you are the underdog fighting a battle against an insurance provider that puts profit over people. We know what it’s like to be the underdog, and that’s why we want to represent you.

You work hard to do your job, so you deserve compensation if you get hurt, and we will work hard to secure your benefits.

You don’t have to fight the insurance provider for your workers’ compensation benefits alone. TopDog Law Personal Injury Lawyers specializes in handling workers’ compensation cases and sincerely empathizes with your situation.

The insurance provider has their lawyer representing them, so hiring an attorney evens the playing field and provides you with an advocate who looks after and protects your interests.

Your lawyer will guide you through the legal process as we pursue workers’ compensation benefits for you. In addition, we will answer your questions and provide regular updates on the status of your case.

That’s not all you can expect us to do as we handle your case. In addition to dedicating time and resources to your workers’ compensation case, we will:

  • Investigate the incident: We need to investigate the cause of your injuries and gather evidence to help build a strong compensation case, including video surveillance footage, photographs, medical records, safety records, inspection logs, witness statements, and expert opinions.
  • Communicate and negotiate with the insurer: We will communicate with the insurance provider on your behalf so they don’t try to take advantage of you. We will also negotiate a settlement that adequately covers your losses.
  • Calculate your claim: We will calculate the amount of workers’ compensation benefits you should receive so we can determine if any offers made by the insurance provider are fair.
  • Represent you: We will represent you at all workers’ compensation hearings. We will also file a lawsuit and represent you in court if necessary because we are not afraid to present your case to a jury.

Your Workers’ Compensation Lawyer Can Recover Damages in Philadelphia

Nobody wants to suffer an injury on the job, but workers’ compensation exists for this reason. You receive benefits that cover your losses, and your employer doesn’t have to worry about a lawsuit because the insurance provider covers the damages.

Unfortunately, insurance companies are profit-driven, which means denying your claim is a way for them to save money. But while the insurance company keeps its profits, you can’t pay your bills, and you can’t work either because of your injury. A workers’ compensation lawyer can take on the insurance provider and recover benefits that cover the following:

  • Medical bills: Workers’ compensation typically covers all of your medical, dental, hospital, and prescription medication expenses that are the result of your injury. This can include emergency care, surgery, hospitalization, diagnostic tests, laboratory work, medical devices, and equipment.
  • Lost income: A workplace injury could prevent you from doing your job, either temporarily or permanently. Workers’ compensation should cover at least part of the income you lose because you can’t work.
  • Disability: Suffering a permanent disability gives you access to disability benefits that provide additional assistance during this difficult time.
  • Gas Mileage: You need fuel to transport yourself to your medical appointments. Reimbursement for travel to and from appointments with your doctor is available. Remember that you must keep your medical appointments because skipping one could stop your benefits.
  • Death: It’s understandably a painful topic, but workers’ compensation entitles you to 51 percent of weekly wages if you lose your spouse because of a workplace injury. If you have one child, you receive 60 percent of your weekly wages. You are also eligible for up to $7,000 to cover funeral costs. We are truly sorry for your loss, and we want to handle your case while you take the time to grieve.

Your workplace injury entitles you to compensation to cover your losses. You require workers’ compensation benefits to pay your bills and care for yourself and your family until you recover and can return to the job. If the insurance provider denies your claim, our firm will take up the fight on your behalf so you can get the benefits you deserve.

Value of Your Benefits

The value of your workers’ compensation benefits will depend on multiple factors, including your average wage amount, the cost of your medical bills, and other expenses you incur due to your injury.

Generally, you should receive at least 2/3rds of the amount you were earning before your injury. It’s also important to report income from other jobs or concurrent employment, which can result in higher benefits.

The insurance provider has 21 days to approve or deny your claim and begin payment of your workers’ compensation benefits under the Pennsylvania Workers’ Compensation Act. You should receive a Notice of Compensation Payable, a Notice of Temporary Compensation Payable, or a Notice of Compensation Denial.

Our firm handles workers’ compensation cases. Workers like you deserve benefits if they get hurt on the job. The insurance company should approve your claim, and your employer cannot fire you in retaliation for filing a claim. Your employer also cannot deny your claim because you’re at fault or have a pre-existing condition. If you are struggling to receive your workers’ compensation benefits, we are here to help.

What to Do After Suffering an Injury in Philadelphia

Receiving approval for your workers’ compensation claim first requires you to complete this process. Doing so will improve the likelihood of getting benefits, although the insurance provider could still deny your claim. A lawyer from TopDog Law Personal Injury Lawyers can help.

Receiving approval for your workers’ compensation claim first requires you to complete this process. Doing so will improve the likelihood of getting benefits, although the insurance provider could still deny your claim. A lawyer from TopDog Law Personal Injury Lawyers can help.

After an injury, you should:

  • Seek medical attention: Your health and well-being come first, so seeking medical attention is the top priority. Inform your doctor that your illness or injury is job-related. This is important because your doctor can document your injury or illness and any treatments you receive. Your employer may require you to see an employer-approved physician within the first 90 days. Outside of that timeframe, you can choose your own.
  • Inform your employer: You should inform your employer as soon as possible but within 120 days of your injury or illness. The sooner you do this, the sooner you may receive workers’ compensation benefits.
  • File a claim with the Pennsylvania Department of Labor and Industry: Your employer must file a First Report of Injury to the state. If your employer denies your claim or fails to file a report, you have three years from the date of your injury or illness to file a claim petition.
  • Fill out all workers’ compensation claim forms: Your employer must fill out all workers’ compensation forms.
  • Obtain legal representation: If you believe your employer or the insurance provider improperly handled your workers’ compensation claim, consulting an attorney is the next step. We here at TopDog Law Personal Injury Lawyers can walk you through the process and present you with options.

Going through the process may seem tedious, but it’s necessary so you can receive benefits. Our firm is committed to helping you receive the benefits you need if your employer or the insurance provider denies your claim. If you need help understanding your rights, we are here to help.

Workers’ Compensation Insurance

Employers must possess workers’ compensation insurance under Pennsylvania law. Workers’ compensation insurance not only provides you with benefits if you suffer an injury or illness on the job, but it also protects employers from direct lawsuits.

Once you report your injury or illness to your employer and you receive medical treatment and the accompanying documentation, the insurance provider should approve your claim and begin making payouts that cover your medical bills, lost income, and other expenses.

You have the right to benefits. You have the right to see your own doctors. You have the right to a hearing if your employer tries to deny or reduce your claim, and you have the right to recover fully before clocking back into work. A workers’ compensation lawyer from TopDog Law Personal Injury Lawyers can protect your rights.

You Only Have a Limited Time to Act

Like other compensation claims, you only have so much time to file a lawsuit. In this case, you only have three years from the date of your injury to file a workers’ compensation lawsuit seeking benefits.

If the deadline in your case passes without you filing a lawsuit, you will lose your right to seek compensation through the legal process. Our law firm will work to meet the statute of limitations in your case.
