At-Fault State: Arizona is an at-fault state. You file your claim directly against the negligent party and their insurer.
Comparative Negligence: Pure comparative negligence (A.R.S. § 12-2505). You can recover even if you are 99% at fault — your award is reduced by your percentage of fault. Insurance companies will try to shift as much fault as possible onto you.
Insurance Minimums: $25,000 per person / $50,000 per accident / $15,000 property damage minimum liability (A.R.S. § 28-4009, effective July 1, 2020).
