Statute of Limitations: 2 years from the date of the negligent act or when the treatment is completed, with a 10-year absolute statute of repose from the date of the act under Tex. Civ. Prac. & Rem. Code § 74.251.
Expert Report Deadline (Critical — Hard Bar): Within 120 days of the date each defendant files an answer to your lawsuit, you must serve each defendant with a detailed expert report identifying the applicable standard of care, how it was breached, and the causal connection to your injuries under § 74.351. Missing this deadline by even a single day requires dismissal with prejudice — meaning the case cannot be refiled — and the defendant is entitled to attorney's fees. This is one of the most unforgiving procedural requirements in the country.
Non-Economic Damages Cap: Texas caps non-economic damages in medical malpractice cases: $250,000 per claimant against all physicians/individual providers combined; $250,000 per claimant per health care institution (maximum $500,000 total across all institutions) under § 74.301. Economic damages (medical bills, lost wages) are not capped.
