Statute of Limitations: 3 years from the date of injury for most personal injury claims under N.C. Gen. Stat. § 1-52. Wrongful death: 2 years from the date of death under N.C. Gen. Stat. § 1-53. Medical malpractice: 3 years from the last act, or 1 year from discovery if the injury was not discovered until 2 or more years after the act, subject to a 4-year hard cap (repose) from the last act under N.C. Gen. Stat. § 1-15(c).

Contributory Negligence (Critical): North Carolina is one of a small number of states that still follows pure contributory negligence.
