Statute of Limitations: 2 years from the date the malpractice occurred OR from the date you discovered (or should have discovered) it — whichever gives you more time — under Pennsylvania's discovery rule (42 Pa. C.S. § 5524(2)).

Statute of Repose (Important Update): Pennsylvania's MCARE Act originally contained a 7-year statute of repose. The Pennsylvania Supreme Court struck it down as unconstitutional in Yanakos v. UPMC (2019). As of 2026, there is no enforceable absolute repose period in most Pennsylvania malpractice cases — but consult an attorney immediately if you believe you may be outside the original 7-year window.

Government Hospital: UPMC and Allegheny Health Network are private entities — government notice requirements do not apply to them. If malpractice occurred at a government-operated facility, 6-month notice is required.

Certificate of Merit (Critical): Pennsylvania requires a Certificate of Merit — a signed statement from a qualified licensed medical professional confirming reasonable probability the care fell below acceptable standards — filed with the complaint or within 60 days (Pa. R. Civ. Pro. 1042.3). Failure to file means dismissal.

No Damages Cap: Pennsylvania has no cap on most medical malpractice damages.

Comparative Negligence: Modified comparative negligence — 51% bar (42 Pa. C.S. § 7102).
