Statute of Limitations: For children under 12 at the time of the malpractice, the filing deadline is 7 years from the date of the injury under Oklahoma medical malpractice tolling rules. For children aged 12 or older, they have until one year after their 18th birthday to file a claim.
Non-Economic Damages Cap: Oklahoma's SB 453 (effective September 1, 2025) caps non-economic damages at $500,000. However, there are limited exceptions for severe physical disfigurement, loss of a limb, and permanent loss of an organ, among other. Economic damages including lifetime care costs are not capped.
