Statute of Limitations: The standard statute of limitations for medical malpractice is 4 years. Minn. Stat. § 541.15(b) suspends the deadline due to infancy, but this extension is capped at a maximum of 7 years, or for no more than 1 year after the disability ceases (whichever occurs first).
Expert Affidavit Requirements: Expert affidavit certifying case merit must be served upon the defendant along with the summons and complaint. A second affidavit summarizing expected testimony and opinions must be served within 180 days after the commencement of discovery.
