Statute of Limitations for Child: 3 years from the date of the negligent act, or 1 year from discovery, whichever is later. If the child was injured before age 10, the lawsuit may be filed before the child's 10th birthday, if that gives more time (Wis. Stat. § 893.56).
5-Year Statute of Repose: Even with the child-under-10 exception, no claim can be filed more than 5 years after the negligent act except when the provider concealed the malpractice or a foreign object was left in the body.
Mandatory Mediation: Wisconsin generally requires requesting mediation before or within 15 days of filing a birth injury lawsuit (Wis. Stat. § 655.44). This tolls (pauses) the statute of limitations.
Damages Cap: Non-economic damages are capped at $750,000 (Wis. Stat. § 893.55(4)). Economic damages — lifetime care costs and lost future earnings — are not capped and can be very substantial.
