Jefferson County recorded 136 deaths on Louisville's public roadways in 2023 — the highest annual total in years per Vision Zero Louisville data. Kentucky statewide recorded 813 traffic deaths in 2023, the highest since 2016 per KYTC, before falling to 707 in 2024 (the 10-year low). Beyond auto accidents, Louisville residents are hurt every year in workplace accidents across the county's manufacturing, healthcare, and logistics sectors, in slip and falls on commercial and residential properties, and in medical negligence at area hospitals. Kentucky's 1-year general personal injury statute of limitations is among the shortest in the country — meaning the clock is running from the moment you're hurt. TopDog fights to get you every dollar you deserve.

Louisville's High Injury Network is well documented by Vision Zero Louisville. Dixie Highway — carrying 60,000+ vehicles per day with a fatality rate three times higher than comparable Kentucky roadways per KYTC data — is consistently Louisville's most dangerous non-interstate corridor. Preston Highway through the South End and Southeast neighborhoods, Bardstown Road through the Highlands, and the Spaghetti Junction interchange where I-65, I-64, and I-71 converge are among the city's documented high-crash zones. UofL Hospital — Louisville's only Level I adult trauma center — and Norton Children's Hospital — the only Level I pediatric trauma center in the region — serve Jefferson County families after the most serious accidents. Those accidents cause real damage to Louisville families and we fight to get injured people the care and money they deserve.
Insurance companies operating across Jefferson County may use Kentucky's choice no-fault rules to minimize what you can recover through PIP and push back on liability claims. Kentucky's 1-year general deadline is strict. We know how to leverage the justice system in Jefferson County Circuit Court to fight back and get you what you may be owed.
IMPORTANT KENTUCKY LEGAL INFORMATION
Statute of Limitations: Kentucky has one of the shortest general personal injury deadlines in the country. Most personal injury claims must be filed within 1 year from the date of injury under Ky. Rev. Stat. § 413.140(1). Car accident cases under Kentucky's no-fault system have a separate 2-year deadline under KRS § 304.39-230(6) — starting from the later of the accident date, the death date, or the date of the last PIP payment. Wrongful death: 1 year from the date a personal representative is appointed to the estate under § 413.180. Medical malpractice: 1 year from injury or discovery, with a 5-year hard cap under § 413.140(2).
Comparative Negligence: Pure comparative negligence under KRS § 411.182. Unlike many states, Kentucky imposes no fault bar. You can recover some compensation even if you are found 99% at fault — though your recovery is reduced by your fault percentage.
Choice No-Fault State: Kentucky uses a "choice" no-fault system under KRS § 304.39 (the Motor Vehicle Reparations Act). Most drivers keep PIP (Personal Injury Protection) coverage of at least $10,000, which pays their own medical expenses and a portion of lost wages regardless of fault. To sue the at-fault driver, you must either: (a) opt out of no-fault coverage in writing, or (b) meet the tort threshold — $1,000 in medical expenses, or a broken bone, permanent disfigurement, permanent injury, or death.
Insurance Minimums: $25,000 per person / $50,000 per accident bodily injury liability; $25,000 property damage; $10,000 PIP required under KRS § 304.39-020 and § 304.39-110.
This is a brief summary of commonly applied laws in the jurisdiction. There are often different laws that apply to different circumstances. Once you hire TopDog, your attorney will advise you on the applicable laws.
Insurance companies in Kentucky may use the choice no-fault framework to limit early recovery while tracking the 1-year general SOL and 2-year car accident SOL. Kentucky has no non-economic damages cap — meaning jury verdicts can reflect the true extent of your injuries. TopDog Law and its co-counsel fight for every dollar.
