IMPORTANT ARKANSAS LEGAL INFORMATION — CAR ACCIDENTS

Statute of Limitations: 3 years from the accident date (Ark. Code § 16-56-105).

Government Vehicle (Critical): If a City of Little Rock, Pulaski County, or Arkansas state agency vehicle was involved, claims are governed by Ark. Code § 21-9-301. Local governments are immune from suit except to the extent covered by liability insurance. Practical notice is typically required within 120 days and suit within 1 year — act immediately.

At-Fault State — No PIP: Arkansas is an at-fault state with no mandatory PIP or no-fault insurance. You file directly against the at-fault driver's insurer for all damages including medical bills, lost wages, and pain and suffering.

Comparative Negligence: Modified comparative fault (Ark. Code § 16-64-122). Recover if 49% or less at fault. If 50% or more at fault, you cannot recover. Insurance companies will try to push your fault percentage to 50% or above.

Insurance Minimums: $25,000 per person / $50,000 per accident minimum bodily injury liability (Ark. Code § 27-22-104). Uninsured motorist coverage is offered by default — reject only in writing.

No Damage Caps: Arkansas does not cap compensatory damages in car accident cases (Ark. Const. Art. 5, § 32).

This is a brief summary of commonly applied laws in the jurisdiction. There are often different laws that apply to different circumstances. Once you hire TopDog, your attorney will advise you on the applicable laws.

Your Case May Be Worth More Than They're Telling You.

Insurance companies may make early low offers because they count on most people not knowing what their case is worth. They may delay, deny, and lowball — counting on financial pressure. TopDog fights for the full recovery.
