IMPORTANT FLORIDA LEGAL INFORMATION — WRONGFUL DEATH
Statute of Limitations: 2 years from the date of death — Fla. Stat. § 95.11(5)(e). Note: This is different from the general 2-year PI deadline. The wrongful death clock starts from the date of death, which may be different from the date of injury. For medical malpractice wrongful death: same 2-year deadline applies.
No Statute of Limitations Exception: Wrongful death claims based on murder or manslaughter have no statute of limitations — Fla. Stat. § 95.11(11).
Who Files: Only the personal representative (executor) of the deceased's estate can file a Florida wrongful death claim — Fla. Stat. § 768.20. Individual family members cannot file separate claims. The personal representative must be appointed through probate if not already named in a will.
Eligible Survivors: Under Florida Statute § 768.18, eligible survivors include the deceased's spouse, children, and parents. Blood relatives and adoptive siblings who were partly or wholly dependent on the deceased may also qualify. Note: "Minor children" under the Florida Wrongful Death Act means under age 25.
Government Entity Notice (Fla. Stat. § 768.28): If a government entity caused the death, written notice to the agency and Florida Dept of Financial Services must be filed within 2 years of the death. The agency has 90 days to investigate before a lawsuit can be filed. Many claims are subject to a $300,000 cap per person.
Comparative Fault: Modified comparative fault with 51% bar — Fla. Stat. § 768.81(6). If the deceased was more than 50% at fault, non-economic damage recovery is barred. Medical malpractice cases follow a pure comparative negligence system.
