Stat. § 768.28): Falls on City of Jacksonville property — sidewalks, parks, public buildings — or JTA bus stops require: (1) Written notice to the agency and Florida Dept of Financial Services within 3 years of the fall; (2) 180-day investigation period before a lawsuit can be filed; (3) Damages capped at $200,000 per person.
Property Owner Liability: Under Florida law, the property owner must have had actual or constructive notice of the dangerous condition — meaning they created the hazard, knew about it, or should have known through reasonable inspection.
Modified Comparative Fault (2023 Change): 51% bar — Fla. Stat. § 768.81(6). Property owners will attempt to push fault above 50% to eliminate your recovery. Document the dangerous condition immediately.
