IMPORTANT FLORIDA LEGAL INFORMATION — MEDICAL MALPRACTICE
Statute of Limitations: 2 years from the date the patient discovered or should have discovered the malpractice — Fla. Stat. § 95.11(4)(b). Discovery rule applies.
Hard 4-Year Repose: Regardless of when you discover the malpractice, you cannot file more than 4 years from the date of the act — Fla. Stat. § 95.11(4)(b). Exception: If fraud or intentional concealment prevented discovery, the repose extends to 7 years.
Child's 8th Birthday Exception: The 4-year statute of repose does not bar a malpractice action brought on behalf of a minor on or before the child's 8th birthday — Fla. Stat. § 95.11(4)(b).
Mandatory Presuit Notice (Critical — Fla. Stat. § 766.106): Before filing a medical malpractice lawsuit in court, you must serve written notice of intent to initiate litigation on each prospective defendant. The defendant has 90 days to investigate. The statute of limitations is TOLLED (paused) while the presuit period runs. No suit can be filed until the 90-day period expires or the claim is formally rejected.
Comparative Fault (Med Mal Exception): Medical malpractice cases use PURE comparative fault — NOT the modified 51% bar that applies to other PI cases. HB 837 did NOT change comparative fault for med mal.
