Statute of Limitations (Medical Malpractice Governs): Birth injuries are medical malpractice claims governed by Fla. Stat. § 95.11(4)(b). 2 years from when the injury was discovered or should have been discovered.
Hard 4-Year Repose — BUT Critical Exception: The 4-year statute of repose from the date of the act does NOT bar an action brought on behalf of a minor on or before the child's 8th birthday — Fla. Stat. § 95.11(4)(b). This means: if a birth injury occurred at delivery, the family has until the child's 8th birthday regardless of the 4-year repose.
Practical Urgency: Despite the 8th birthday deadline, acting early is critical. Medical records can be lost or become harder to obtain. Hospital staff rotate and memories fade. Evidence is strongest immediately after the injury.
Mandatory Presuit Notice (Critical — Fla. Stat. § 766.106): Before filing a birth injury lawsuit in court, written notice of intent to initiate litigation must be served on each prospective defendant. The defendant has 90 days to investigate. The statute of limitations is tolled while presuit runs.
Med Mal Comparative Fault Exception: Birth injury cases (as med mal) still use PURE comparative fault — not the 51% bar that HB 837 created for other PI cases.
Government Hospital: UF Health Jacksonville may be subject to Fla. Stat. § 768.28 government notice requirements.
