IMPORTANT TEXAS LEGAL INFORMATION — MEDICAL MALPRACTICE

Statute of Limitations: 2 years from the date of the negligent act, or from the date the medical treatment that is the subject of the claim is completed — whichever is later (Tex. Civ. Prac. & Rem. Code § 74.251(a)). Clock starts from the later of: occurrence of the breach, or end of the course of treatment.

Statute of Repose (Hard Absolute Deadline): No claim may be filed more than 10 years after the date of the negligent act, regardless of when the injury was discovered — even for minors (Tex. Civ. Prac. & Rem. Code § 74.251(b)). This 10-year wall cannot be overcome.

Minor Exception: If the injured patient was under age 12 at the time of the malpractice, the claim must be filed by the patient's 14th birthday, even if that falls outside the 2-year window.

60-Day Pre-Suit Notice Required: Before filing, written notice of the claim must be served on each healthcare provider by certified mail at least 60 days before filing (Tex. Civ. Prac. & Rem. Code § 74.051). This notice tolls the statute of limitations for 75 days.

120-Day Expert Report Required: Within 120 days of filing, an expert report establishing the standard of care, breach, and causation must be served on each defendant (Tex. Civ. Prac. & Rem. Code § 74.351). Failure results in mandatory dismissal with prejudice.

Noneconomic Damage Caps: $250,000 per claimant against all physicians/individual providers combined; $250,000 per claimant per healthcare institution (max $500,000 across all institutions). Maximum noneconomic damages: $750,000 total. Economic damages (medical bills, lost wages, future care costs) are not capped (Tex. Civ. Prac. & Rem. Code §§ 74.301, 74.303).
