IMPORTANT NORTH CAROLINA LEGAL INFORMATION — WRONGFUL DEATH

Statute of Limitations: 2 years from the date of death (N.C. Gen. Stat. § 1-53(4)). The clock starts on the date of death — not the date of the original injury. Note: 2 years for wrongful death versus 3 years for personal injury — wrongful death has a SHORTER deadline.

Who Can File (N.C. Gen. Stat. § 28A-18-2): The personal representative of the deceased's estate must file the wrongful death action. If no personal representative has been appointed, one must be appointed through the probate court before filing.

Medical Malpractice Wrongful Death: Subject to the same procedural requirements as other med mal claims — Rule 9(j) expert affidavit required with complaint. Also subject to the 4-year statute of repose: if the negligent act occurred more than 4 years before the death, the wrongful death claim based on that malpractice may be barred (§ 1-53(4) proviso).

Contributory Negligence: North Carolina's pure contributory negligence rule applies to wrongful death cases. If the deceased was found to have contributed in any way to the cause of their death, the family's recovery may be completely barred. Limited exceptions: Last Clear Chance doctrine and gross negligence.

Recoverable Damages (§ 28A-18-2): Medical and funeral expenses, pain and suffering of the deceased before death, loss of income the deceased would have earned, loss of companionship for surviving family members, and punitive damages where appropriate.
