Workers' Compensation Exclusivity: Under the Workers' Disability Compensation Act, workers' compensation is generally your exclusive remedy against your direct employer, meaning you cannot separately sue your employer for more even if they were careless.
Third-Party Liability: General contractors, subcontractors, property owners, architects, engineers, and equipment manufacturers who are not your direct employer may be separately liable under common law negligence and, where a hazardous property condition contributed to the accident, premises liability. A third-party claim can include pain and suffering, which workers' compensation does not cover.
MIOSHA Violations: You cannot sue under MIOSHA directly, and MIOSHA does not pay injured workers. Documented MIOSHA citations can be used as evidence of negligence in a third-party civil claim.
Statute of Limitations: Workers' compensation requires notice to your employer within 90 days and a formal claim made within 2 years of the injury, the date disability manifests, or your last day of employment with that employer, whichever is later. A separate third-party personal injury claim generally must be filed within 3 years.
Government Entity Deadline: If a government entity owned or controlled the site or was otherwise involved, a written notice may be required in as little as 120 days depending on the type of claim. Missing this notice can permanently bar a claim against that government entity.
Comparative Fault: Michigan follows modified comparative fault. You can recover pain and suffering damages if you are 50% or less at fault, reduced by your fault percentage. If you are found more than 50% at fault, you cannot recover pain and suffering, though you may still recover a reduced share of economic damages such as medical bills and lost wages.
