IMPORTANT COLORADO LEGAL INFORMATION — WRONGFUL DEATH
Statute of Limitations: 2 years from the date of death (C.R.S. § 13-21-204). The clock starts at death — not at the date of the underlying injury.
Exception — Vehicular Homicide: If the death resulted from vehicular homicide where the driver also left the scene, the statute of limitations is 4 years (C.R.S. § 13-80-102(2)).
Government Entity (Critical): If a government vehicle, RTD bus, or public entity caused the death, a Notice of Claim must be filed within 182 days of the death under the CGIA (C.R.S. § 24-10-109). Suit must be filed within 2 years. Act immediately.
Who Can File — Staggered Rights Under C.R.S. § 13-21-201 (HB 24-1472, eff. 1/1/2025):
Year 1 after death: Surviving spouse generally has the exclusive right (or heirs/designated beneficiaries if no spouse).
Year 2 after death: Surviving spouse AND children may file, or join an existing suit. Parents may file if no spouse or children exist.
Limited circumstances: Siblings were added as eligible filers by HB 24-1472 (eff. 1/1/2025) when no spouse, heirs, parents, or designated beneficiaries exist.
Separate from Criminal: A civil wrongful death lawsuit is entirely separate from any criminal case. No conviction is required.
Noneconomic Damages Cap: $2.125 million for suits filed on or after January 1, 2025 (C.R.S. § 13-21-203). No cap if the death resulted from a felony killing.
Economic Damages: No cap.
