Statute of Limitations: 2 years from the date of death — Ala. Code § 6-5-410. The clock starts from death, not from the date of the accident or negligent act.
Who Can File: Generally, only the personal representative of the deceased's estate may file a wrongful death lawsuit — Ala. Code § 6-5-410. The spouse, children, and parents cannot file directly. The personal representative must be appointed by the probate court first. If the deceased was a minor, the parents may file within 6 months of death — Ala. Code § 6-5-391.
Government Entity Deadline (Critical): If a City of Birmingham vehicle or employee caused the death, written notice must be filed within 6 months (Ala. Code § 11-47-23). Jefferson County requires notice within 12 months (Ala. Code § 11-93-2).
Damages — Punitive Only (Alabama's Unique Rule): Alabama is virtually unique among all 50 states in that wrongful death damages are PUNITIVE ONLY. There are no compensatory damages — no recovery for lost wages, funeral expenses, medical bills, or loss of companionship. The jury punishes the defendant based on the wrongfulness of their conduct. There is no cap on wrongful death damages with the exception of when the defendant is a governmental entity.
Separate from Criminal Proceedings: A civil wrongful death lawsuit is entirely separate from any criminal case.
