IMPORTANT MARYLAND LEGAL INFORMATION — WRONGFUL DEATH

Statute of Limitations: 3 years from the date of death — CJP § 3-904(g)(1). Note: The clock starts at the date of death, not the date of the underlying injury or accident.

Occupational Disease Exception: If death was caused by an occupational disease, file within the earlier of 10 years from time of death or 3 years from date the cause of death was discovered — § 3-904(g)(2).

Who Can File: Spouse, parents, and children of the deceased (primary beneficiaries) — CJP § 3-904(a)(1). If none of those relatives exist, any person related by blood or marriage who was substantially dependent on the deceased may file — § 3-904(b). Only one wrongful death action may be filed — § 3-904(f).

Government Entity Deadlines (Critical — Run Simultaneously With 3-Year SOL):

— State agencies: 1-year notice to State Treasurer under MTCA — $400,000 cap.

— Baltimore City, Baltimore County: 1-year notice to appropriate local official under LGTCA — $400,000/$800,000 cap to all damages combined.

— MTA: 1-year notice to MTA Administrator.

Contributory Negligence Applies: If the deceased was partly at fault for their own death, Maryland's contributory negligence rule may completely bar recovery. Defense teams will look for any fault on the deceased.

Noneconomic Damages Cap (Wrongful Death): For deaths occurring between October 1, 2025 and September 30th, 2026, wrongful death noneconomic damages with 2+ beneficiaries are capped at $1,447,500 — CJP § 11-108.

Survival Action: Maryland also allows a separate survival action by the deceased's personal representative for damages the deceased suffered before death.
