Wrongful death is the most devastating outcome of someone else's negligence. Car accidents on Baltimore's most dangerous corridors, construction accidents, medical malpractice at area hospitals, and Port of Baltimore incidents claim lives every year. Maryland recorded 582 traffic fatalities in 2024 per MDOT SHA data. Families are left without a spouse, a parent, a child. Insurance companies and defense attorneys may minimize the loss of life and use delay tactics to pay grieving families as little as possible. TopDog fights to get you every dollar your family deserves.

Wrongful deaths in Baltimore happen on I-95 and I-83, in construction zones and Port operations across Baltimore City, in hospital rooms at Johns Hopkins and University of Maryland Medical Center, and in workplaces throughout the metro. We know how these cases are built in Maryland and how to hold defendants accountable. Those losses cause real damage to families and we fight to get them the justice and financial security they deserve.
Insurance companies and defense attorneys across Baltimore often use delay, denial, and lowball tactics to minimize the loss of life and pay grieving families as little as possible. Maryland's contributory negligence rule applies in wrongful death cases — defense attorneys will aggressively try to assign any fault to the deceased. MTA and Baltimore City government involvement require written notice within 1 year. We know how to leverage the justice system in Maryland courts to fight back and protect your family's right to full recovery.
IMPORTANT MARYLAND LEGAL INFORMATION — WRONGFUL DEATH
Statute of Limitations: 3 years from the date of death — CJP § 3-904(g)(1). Note: The clock starts at the date of death, not the date of the underlying injury or accident.
Occupational Disease Exception: If death was caused by an occupational disease, file within the earlier of 10 years from time of death or 3 years from date the cause of death was discovered — § 3-904(g)(2).
Who Can File: Spouse, parents, and children of the deceased (primary beneficiaries) — CJP § 3-904(a)(1). If none of those relatives exist, any person related by blood or marriage who was substantially dependent on the deceased may file — § 3-904(b). Only one wrongful death action may be filed — § 3-904(f).
Government Entity Deadlines (Critical — Run Simultaneously With 3-Year SOL):
— State agencies: 1-year notice to State Treasurer under MTCA — $400,000 cap.
— Baltimore City, Baltimore County: 1-year notice to appropriate local official under LGTCA — $400,000/$800,000 cap to all damages combined.
— MTA: 1-year notice to MTA Administrator.
Contributory Negligence Applies: If the deceased was partly at fault for their own death, Maryland's contributory negligence rule may completely bar recovery. Defense teams will look for any fault on the deceased.
Noneconomic Damages Cap (Wrongful Death): For deaths occurring between October 1, 2025 and September 30th, 2026, wrongful death noneconomic damages with 2+ beneficiaries are capped at $1,447,500 — CJP § 11-108.
Survival Action: Maryland also allows a separate survival action by the deceased's personal representative for damages the deceased suffered before death.
This is a brief summary of commonly applied laws in the jurisdiction. There are often different laws that apply to different circumstances. Once you hire TopDog, your attorney will advise you on the applicable laws.
Insurance companies and defense attorneys may make early low offers and often use delay tactics to minimize the loss of life. Maryland caps non-economic damages in wrongful death but economic damages are uncapped. TopDog fights to establish full fault and secure your family's full economic recovery.
