Government Entity (Critical): Claims against the City and County of Denver, CDOT, RTD, Denver Public Schools, or any public entity require a written Notice of Claim within 182 days of the injury under the Colorado Governmental Immunity Act (C.R.S. § 24-10-109). Miss this deadline and your case against that government entity is typically barred.

At-Fault State: Colorado is an at-fault state. No mandatory no-fault or PIP system exists. You file your claim directly against the negligent party and their insurer.

Comparative Negligence: Modified comparative fault (C.R.S. § 13-21-111). You can recover if your fault is 49% or less. At 50% or more fault, you recover nothing. Insurance companies will push your fault percentage to reduce their payout.

Insurance Minimums: $25,000 per person / $50,000 per accident / $15,000 property damage minimum liability (C.R.S. § 10-4-619).

Noneconomic Damages Cap: For most personal injury suits filed on or after January 1, 2025, noneconomic damages (pain and suffering) are capped at $1.5 million (C.R.S. § 13-21-102.5). Economic damages — medical bills, lost wages — are not capped.
